Roosevelt and SCOTUS

If we got back to our origins we would not have to sweat the election of justices to the Supreme Court.

Hell, if we went back to our origins even some slob like me would be able to do a good job as a Supreme Court justice.

The job of SCOTUS is basically to look at the laws enacted by Congress and the several states and make sure they fit into the outlines of a Constitution that was written in simple English.

It's not that hard of a job.

The weaponization of SCOTUS for the most part started during the FDR administration because  Roosevelt wanted to play fast and loose with the Constitution. 

There is no legal size for the Supreme Court, it has been nine justices since Day one but that has just been a custom. FDR wanted to pack it because he had several of his programs over ruled. He was talked out of it but he managed to get enough justices replaced over time to enable him to to run loose with the Constitution.

Prior to this SCOTUS wasn't very political. It was just nine old men simply using the Constitution as a guideline. FDR in effect weaponized SCOTUS for his own gain and most presidents since have done the same thing. 

I think it would be a joy to have SCOTUS go back to its roots where it belongs, simply with the duties of reading and enforcing the Constitution.
